1 . Learned Senior counsel submits that the sole ground for not promoting the petitioner was certain observations that came against him in the judgment passed by learned Special Judge, Narnaul dated 16.10.2015, wherein though he was not an accused, which have been even otherwise been stayed by this Court in CRM-M-40689-2015 on 02.12.2015, Annexure P-3. In wake of the above, he prays that the claim of the petitioner needs to be considered for promotion from the date of his juniors i.e. 05.03.2019, as Deputy Superintendent of Police, as per the judgments of Hon’ble the Supreme Court in Union of India and Others vs. K.V. Jankiraman and Others , (1991) 4 Supreme Court Cases 109; Union of India and Others vs. Doly Loyi , 2024 SCC OnLine SC 2613; Union of India and Others vs. Sangram Keshari Nayak , (2007) 6 Supreme Court Cases 704 and this Court in Ashok Kumar vs. State of Haryana and Others , CWP-8094-2018, decided on 08.01.2019.

hearing, learned State counsel fairly states that the authority would not be averse to having a relook at the matter and consider it, taking note of the aforesaid submissions, order, Annexure P-3 and the judgments referred to hereinabove, and decide the same, within a period of 6 months, in accordance with law, after affording a proper opportunity of hearing to the petitioner, which this Court has no reason to believe the authorities would not be addressed in a just, fair and reasonable manner.

The matter stands disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and he shall be free to seek legal redress thereupon.
