The present civil writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for setting aside the judgment/decree dated 06.02.2025 (Annexure P-6) passed by the learned Additional District Judge, Jhajjar, whereby the judgment/decree dated 22.08.2024 (Annexure P-4) passed by the learned Election Tribunal-cum-Civil Court, Bahadurgarh was set aside and recounting of votes by identification was directed, which is stated to be impracticable.
Learned counsel for the petitioner submits that he seeks permission to withdraw the present petition on the ground that, during the interregnum, recounting has already been conducted and, as per the same, the petitioner has been declared the returned candidate.
Learned counsel further submits that the orders based on which the recounting was done should not be waived off simply on withdrawal of the writ petition MAHIMA2026.05.15 09:44 because the cause of action has come to an end. would have no objection if the petitioner is permitted to withdraw the petition and the submissions made by him are taken on record.
