Instant petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking issuance of a writ in the nature of certiorari for quashing the order dated 03.10.2025 (Annexure P-4), passed by respondent No.3 to the extent vide which the appeal filed by the petitioner challenging the order of dismissal dated 24.02.2025 (Annexure P-2), passed by respondent No.4 by invoking Article 311(2)(b) of the Constitution of India has been kept pending till final decision of the case by trial Court in FIR No.17 dated 24.02.2025 registered under Sections 7, 7-A of the Prevention of Corruption Act and under Section 61(2) of the BNS, 2023 at Police Station C-Division, District Amritsar City.

Learned counsel for the petitioner submits that against the order dated 24.02.2025 (Annexure P-2), whereby petitioner has been dismissed from service, petitioner has filed a statutory appeal

(Annexure P-3), which has not been disposed of on merits and in the order dated 03.10.2025 (Annexure P-4) only it has been stated that the same has been kept pending till the final orders in aforesaid case FIR No.17 dated 24.02.2025.

Learned State counsel submits that the statutory appeal (Annexure P-3) of the petitioner shall be considered and disposed of by respondent No.3 within a period of three months from today, by passing a well-reasoned speaking order after affording an opportunity of personal hearing to the petitioner.
