This is a Civil Writ Petition under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus / certiorari for declaring the acquisition proceeding of the land measuring 39 kanals 7 marlas comprising in khewat no.151, khatauni no.237, mustil/ rect.no.131, killa nos.3/2, 8, 9/1, 10, 12, 13, 19 and 22 in village Mewla Maharajpur, Tehsil and District Faridabad, Haryana acquired vide notification under Section 4 read with Section 17(1) of the Land Acquisition Act, 1894 followed by declaration under Section 6 read with Section 17(2)(c) of the Land Acquisition Act, 1894 dated 14.08.1962 as illegal.

Learned counsel for the respondents has pointed out that in the present case the petitioner is a subsequent purchaser by virtue of the sale deed dated 24.01.2007. It is submitted that it is a matter of settled law that subsequent purchaser cannot challenge the acquisition.

Learned counsel for the petitioner has fairly submitted that the petitioner be permitted to withdraw the present writ petition. It is submitted that one of the prayers made in the writ petition is to fix CWP-1072-2008 for hearing and has submitted that the said prayer of the petitioner be kept open.

In view of the above, the present writ petition is dismissed as withdrawn. The prayer of the petitioner to fix CWP-1072-2008 for hearing is kept open. In case any such application in the said CWP is filed, the same would be considered independently.
