The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of certiorari, for quashing the order dated 01.03.2013 (Annexure P-3), passed by respondent No.2, whereby one annual increment of the petitioner is ordered to be stopped with cumulative effect and setting aside the order dated 14.09.2016 (Annexure P-5), whereby the appeal dated 10.03.2013 (Annexure P-4) filed by the petitioner has been dismissed.

On the last date of hearing i.e. 13.07.2026, the following

“One of the grounds raised in the present petition is that the order passed by the Appellate Authority is totally cryptic and non-speaking as none of the points raised in the appeal has been considered.

Faced with this situation, learned counsel for the respondents seeks an adjournment to get instructions.

Learned counsel for the respondents, on instructions, submits that the withdrawal of the order of the Appellate Authority would require the approval from the Chairman and the same would take time.

Since the order passed by the Appellate Authority dated 14.09.2016 (Annexure P-5) is totally cryptic and non-speaking as no reasons have been assigned in the said order, the same is hereby set aside and the matter is remanded back to the Appellate Authority to reconsider the appeal after affording an opportunity of personal hearing to the petitioner and dispose of the same within a period of three months from the date of receipt of certified copy of this order.
