The petitioners have filed the instant petition under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to finalize seniority of the cadre of Platoon Commanders after taking into consideration the objections raised by the petitioners and others against the tentative seniority lists dated 02.04.2018, 14.12.2018 & 21.05.2019 (Annexure P-2 to P-4) and till such time, no promotion be made on the basis of any provisional seniority lists and after finalization of the seniority list, consider the petitioners-Platoon Commanders for promotion to the next higher post of Company Commanders.

No.4 to 8 has submitted that the prayer in the present petition is for finalisation of seniority, whereas the same has already been finalized and the seniority list has also been fixed. He prays for some time to file an affidavit in this regard.

Learned counsel for respondents No.4 to 8 has filed an affidavit of respondent No.4 along with copy of order dated 05.07.2024 (Annexure R-4/1), passed by the Special Director General of Policecum-Commandant General, Punjab, Home Guards and Director, Civil Defence, Punjab, Chandigarh and judgment dated 12.01.2024 (Annexure R-4/2), passed by this Court, in CWP-23866-2019 titled as ‘Mohandeep Singh and others Vs. State of Punjab and others’ and other connected cases, which is taken on record. He submits that in view of the directions issued in the judgment dated 12.01.2024, the respondents have passed the speaking order dated 05.07.2024 (Annexure R-4/1) and

in this view of the matter, the instant petition has been rendered infructuous. He further submits that even the order dated 05.07.2024 has been challenged by the aggrieved persons in CWP-19713-2024 titled as ‘Harminder Singh and others Vs. State of Punjab and others’ which is pending for 16.09.2026.

Learned counsel for the petitioner does not dispute the abovesaid factual aspect of the matter.
