Prayer in this writ petition is for quashing impugned order dated 21. 0 3.2024 (Annexure P-15) reje c ting the representation dated 09.02.202 4 (Annexure P-14) for grant o f sanction for extension of contractua l service for the post of Data E n try Operator on the ground of poor perfo r mance, whereas no notice was e ver given to the petitioner for such poor performance in duties; furthe r for quashing the impugned order date d 27.02.2024 (Annexure P-16), replacing the petitioner with another se t of contractual employee being voilative of settled principles of law and without obtaining the sanction f or contractual employment for the year 2024; further for quashing th e impugned action of the responden t for levelling false allegati o n for obtaining the bogus experience certificate, as the same was issued by the respondent No.4, and all th e experience certificates have b e en issued to the petitioner by the respo n dent authorities because the petitioner is working and remained posted with the office of r e spondent No.4 since 2011;

AND/OR further for quashing the imp u gned order dated 21.12.2023 (Annexure P -12), to the extent that the sa n ction for renewal of Service Agreemen t /Contract in case of the petiti o ner has not been sought and granted b y the respondent authorities wh i le seeking such sanction and granted in case of juniors to the petitioner as per the date of appointment mentioned therein; and for quashing the impugned Order dated 28.12.202 3 (Annexure P-13), whereby, t h e petitioner is relieved from service, without assigning any reasons and being in violation of the terms and con d itions of the Service Agreement/Contract and being discrimina t ory while granting the extensi o n of contract of service up to 31.12.202 4 to the juniors to the petitioner, as well as being voilative of settled pri n cipal of law “first-come last go”.
After arguing for some time, w hen this Court is not inclined to interfer e in the matter, learned counsel for the petitioner submits that he may be permitted to withdraw the inst a nt petition with liberty to the petitioner t o take recourse to the appropri a te remedy in accordance with law includ i ng Arbitration as provided in t h e Service/Contract Agreement dated 01.0 1 .2021 (Annexure P-9), if any.
Permitted to do so.
Dismissed as withdrawn, wi t h the liberty aforesaid. Pending application(s), if any , shall stand disposed of.
