This petition has been filed with a prayer to set aside the recovery proceedings initiated by respondent No.4 pursuant to the order dated 01.02.2023.

It is alleged that the procedure stipulated by law had not been followed and that for a certain period, the liquor vend remained closed due to the COVID-19 pandemic.

Be that as it may, we find that the order pursuant to which the recovery has been initiated is dated 01.02.2023. Except for stating that some representation has been made in the matter, there is nothing on record to show why the said order was not challenged in appropriate proceedings.

The recovery is admittedly a consequence of the order dated 01.02.2023. Without laying any challenge to the said order in appropriate proceedings, it would not be open to the petitioner to approach this Court
