The prayer in the present petition under Section 226 of the Constitution of India read with Section 482 of Cr.P.C. is for issuance of Writ in the nature of Certiorari or Mandamus directing the respondents to release the petitioner prematurely on usual terms and conditions in view of the Policy dated 08.07.1991 and in view of the judgment titled as Surinder Kumar @ Chhinda Versus State of Haryana.

The learned counsel for the petitioner contends that in terms of the Policy dated 08.07.1991, the petitioner has to undergo actual sentence of 10 years and with remission 14 years. actual sentence of 14 years and 29 days and with remission 16 years. Therefore, he is entitled to the grant of release pre-maturely.

The counsel for the State very fairly submits that the case of the petitioner is covered by the Policy dated 08.07.1991 inasmuch as the petitioner has undergone more than 10 years of actual sentence and more than 14 years of sentence with remission.

In view of the above, the present petition is allowed. The petitioner is ordered to be released pre-maturely on usual terms and conditions.
