This is an applica�on for condona�on of delay of 42 days in filing the present revision pe��on.

For the reasons men�oned in the applica�on, the same is allowed and delay of 42 days in filing the revision pe��on is condoned.

The present pe��on has been filed against the impugned judgment of convic�on and order of sentence dated 17.08.2019 passed by learned Judicial Magistrate Ist Class, Dhuri vide which pe��oners have been convicted and sentenced under Sec�ons 323, 341, 325, 506 IPC and also against judgment dated 28.11.2025 passed by learned Addi�onal Sessions Judge, Sangrur whereby appeal of the pe��oners has been partly dismissed as the judgment of convic�on has been upheld.

Counsel for the pe��oners submits that vide judgment dated 28.11.2025, the learned Appellate Court, Sangrur modified the order of sentence and granted the relief to the pe��oners to be released on proba�on for a period of one year. It was further directed that the pe��oners shall furnish personal bonds in the sum of ₹10,000/- each, along with one surety of the like amount, within 15 days. compensa�on before the trial Court within one month, to be disbursed to the injured/ his legal heirs.

Counsel for the pe��oners submits that the pe��oners could not furnish the proba�on bonds within the s�pulated period as they were not properly guided by their counsel before the Appellate Court. He further submits that the pe��oners, being illiterate rural villagers, were not aware of the legal technicali�es and, therefore, could not comply with the order passed by the learned Addi�onal Sessions Judge, Sangrur. He further submits that pe��oners No. 1 and 2 were arrested a few days ago, whereas pe��oner No. 3 has not been arrested so far. However, all the pe��oners are now ready and willing to furnish the requisite personal and surety bonds in terms of the order passed by the learned Appellate Court, Sangrur.

The limited prayer made by pe��oners is men�oned in para No. 5 of the pe��on, which reads as follows:

5. That the limited prayer for of the pe��oners in the present revision pe��on is only to the extent that order of the ld. Appellate Court, Sangrur for releasing the pe��oners on proba�on for a period of one year may please be upheld but with the modifica�on that the �me for furnishing the personal bonds with one surety of the like amount and for payment of compensa�on of Rs.15000/- payable to injured, may kindly be granted afresh and the pe��oners undertake to abide by all the direc�ons and orders of the Hon'ble High Court in this respect. The pe��oners also tenders uncondi�onal apology before this Hon'ble High Court for non compliance of the orders of the Id. Appellate Court, Sangrur and beg pardon of the said default, which is based on unavoidable circumstances as explained above.

Since the pe��oners have already been extended the benefit of proba�on, the furnishing of bonds is only a formality and the same cannot be denied to them merely on the ground of non-furnishing within the s�pulated period, par�cularly when the explana�on furnished appears to be correct.

Given prayer of pe��oners, the present pe��on is allowed to the extent that �me to furnish the requisite bonds in terms of para 18 of the judgment dated 28.11.2025 passed by the learned Appellate Court, Sangrur is extended �ll 30.04.2026. Pe��oners No. 1 and 2, who are in custody be released forthwith on furnishing requisite bonds. It is clarified that any warrant issued against pe��oner No. 3 shall remain in abeyance �ll 30.04.2026.

Present applica�on has been filed for suspension of sentence of the applicants during the pendency of the present revision pe��on.
