T hrough the instant petition filed under Section 482 of th e Bharatiya Na g arik Suraksha Sanhita, 2023 (f o r short “BNSS”), the petitione r seeks anticip a tory bail in case FIR No.131 d a ted 24.07.2025 registered unde r Sections 118( 2 ), 115(2), 3(5) of the Bharatiy a Nyaya Sanhita, 2023 at Polic e Station Ghum a n, District Gurdaspur.

O n 17.04.2026, the following or d er was passed by this Court: - “Prayer in the present pe t ition filed under Section 482 o f t h e BNSS, 2023 is for grant of a n ticipatory bail to the petitione r i n case FIR No.131 dated 24.07 . 2025 registered under Section s 118(2), 115(2), 3(5) of the Bh a ratiya Nyaya Sanhita, 2023 a t P olice Station Ghuman, District G urdaspur.

Learned counsel for th e petitioner contends that th e petitioner has been falsely imp l icated in the present case. H e argued that even if the contents of the FIR are taken to be true ,

only role attributed to the petitio n er is that he raised lalkara an d g ave datar blow on the right le g and further gave a datar blo w ( r everse side) on the back of the c omplainant which is a non-vita l part of the body. He submits t h at the alleged occurrence too k place on 14.07.2025, whereas th e FIR in question was registere d on 24.07.2025 i.e. after an unex p lained delay of 10 days thereb y c a sting serious doubt on the pro s ecution story. Learned counse l has further submitted that the p e titioner is ready and willing t o j o in the investigation as and w h en called upon to do so by th e i n vestigating agency.

On the other hand, learne d State counsel has opposed th e prayer for grant of anticipato ry bail, by submitting that th e allegations levelled against the p e titioner are serious in nature. Adjourned to 28.04.2026.

In the meantime, the p etitioner is directed to joi n i n vestigation within a week from today and would appear as an d w hen required by the Investiga t ing Officer and cooperate wit h t h e Investigating Agency. In the event of arrest, he shall b e admitted to interim bail on furni s hing of bail/surety bonds to th e s a tisfaction of Arresting/Invest i gating Officer. The petitione r s h all also abide by the conditi o ns as envisaged under Sectio n 482(2) of BNSS, 2023.”

L earned counsel for the petition e r submits that in compliance o f the order dated 17.04.2026 passed by this Co u rt, the petitioner has joined th e investigation.

L earned counsel for the State, on instructions of ASI Satpa l Singh, has su b mitted that the petitioner has j o ined the investigation and is n o longer required for further investigation.

I n view of the statement made by learned State counsel, th e interim order dated 17.04.2026 passed by th i s Court, is made absolute. Th e
