Present petition has been filed under Section 483 of the BNSS seeking regular bail in case FIR No. 25 dated 01.03.2025, registered under Section 22-C of the NDPS Act at Police Station Sadar Nakodar, District Jalandhar Rural.

2 . As per the allegations in the FIR, police party allegedly recovered 95 tablets containing the salt Etizolam, weighing 10.165 grams, from the possession of the petitioner, Surjit Singh @ Sonu.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and the alleged recovery has been planted upon him, whereas no such recovery was ever effected. Without entering into the merits of the case, learned counsel submits that although the alleged recovery falls within the commercial quantity as prescribed under the NDPS Act, petitioner is in custody for a period of last one year and three months. case under the provisions of the NDPS Act is registered against the petitioner, in which he has already been granted the concession of bail. 4. In view of the above, present petition is disposed of with liberty to the petitioner to file a fresh petition for grant of regular bail after undergoing custody for a period of more than one year and seven months.
