The prayer in the present petition under Section 483 of BNSS, 2023 is for the grant of regular bail to the petitioner in case FIR No.270 dated 26.10.2020 under Sections 302, 120-B, 34 IPC and Sections 25 & 27 of the Arms Act, registered at Police Station City Jhajjar, District Jhajjar.

The learned counsel for the petitioner contends that two eyewitnesses, namely, Ravi alias Kaka and Karan alias Kannu have not supported the prosecution case. Three weapons recovered from 03 of the 04 accused have not been connected to the offence in question as per the report of the FSL. As the petitioner is in custody since 28.08.2021 and only 10 of the 30 prosecution witnesses have been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

The learned counsel for the State, on the other hand, while referring to the reply dated 29.06.2026 contends that the petitioner is a serial offender. The allegations levelled against him and his co-accused are grave and do not entitle him to the concession as prayed for. He, however, concedes that the petitioner is in custody since 28.08.2021 and only 10 out of the 30 prosecution witnesses have been examined so far.

I have heard the learned counsel for the parties.

Admittedly, the material prosecution witnesses have turned hostile. Whether the remaining evidence is sufficient to establish the culpability of the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. The petitioner is in custody since 28.08.2021 but only 10 of the 30 prosecution witnesses have been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required.

Thus, without commenting upon the merits of the case, the present petition is allowed and the petitioner, Ravi @ Bhola is ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned.

The petitioner shall appear before the police station concerned on the first Monday of every month till the conclusion of the trial and inform in writing each time that he is not involved in any other case except the cases referred to in the State reply dated 29.06.2026.
