The petitioner is seeking regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) (Section 439 Cr.P.C.) in FIR No.57 dated 19.03.2020 under Sections 420 and 120-B of IPC registered at Police Station Sector 36, U.T. Chandigarh.

The case of the prosecution is that the FIR has been registered on the basis of the complaint of Ms. Urmila Kanwar, who alleged that she was duped in a cyber fraud. She befriended a person on Facebook who induced her to transfer money on the pretext of customs clearance and other charges for gifts purportedly sent to her. Acting on his representations, she transferred more than 6,00,000/- into the bank account specified by the₹ fraudsters before realizing that she had been cheated. The allegation against the petitioner is that the whole amount was credit in his bank account.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. His account has been misused for committing cyber fraud. He further submits that the

petitioner is in custody for the last 11 months and 09 days. He, thus, prays for grant of bail to the petitioner.

Mr. Narender Kumar Vashisht, Addl. P.P. U.T. Chandigarh accepts notice on behalf of the State and has vehemently opposed the prayer for grant of regular bail to the petitioner on the ground of gravity of allegations. Learned State counsel has filed the custody certificate in the Court today and the same is taken on record. He further submits that as per the custody certificate, the petitioner is in custody for the last 11 months and 09 days.

After hearing the rival contentions of the learned counsel for the parties and keeping in view the facts and circumstances of the case that the petitioner is in custody for the last 11 months and 09 days; the conclusion of trial would take time; as such, continuous detention of the petitioner would not serve the ends of justice, this Court deems it fit to grant the concession of regular bail to the petitioner during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.
