This order shall dispose of two petitions bearing No. CRM-M6950-2026 titled as Amritpal Singh @ Amrit Versus State of Punjab and CRM-M-7258-2026 titled as Veerpal Singh @ Golu @ Rajbir Singh Raja Versus State of Punjab and as the same are arising out of the same FIR.

However, for the sake of convenience the facts have been taken from CRMM-6950-2026.

The prayer in the present petitions under Section 483 of BNSS, 2023 is for the grant of regular bail to the petitioners in case FIR No.183 dated 19.10.2025 under Section 111 BNS, 2023 and Sections 25/25(6)/25(7)(i), 25(8)/54 of Arms Act, 1959 registered at Police Station Bhikhiwind, Tarn Taran.

3 The FIR came to be registered on the basis of secret information and reads as under:-

CT Gurpreet Singh No. 427/T, including laptop and printer were on government vehicle No. Pb-46-W-0526 whose driver PHG Gurchanan Singh No. 4391 and private vehicle were searched by the patrolling party, in connection with Bad elements. CIA staff Tarn Taran and Tarn Taran City. When the police party was patrolling from the nearby BSF Head Quarter Bhikhiwind and When the informant reached the front, he gestured to stop the government vehicle by waving hands, which the ASI stopped, the informant expressed his desire to talk to me by taking me sideways, which the ASI talked to the informant on the side, he informed that Lakhbir Singh alias Ladda resident of Harike, Satnam Singh alias Satta resident of Nejihra Panua, Gurdev Singh Jaisal resident of Chambal and Gurjant Singh alias Jatta resident of Jawanda who are gangsters and are currently abroad with their associates Veer Pal Singh

alias Galu alias Rajbir Singh Raja son of Satnam Singh, Gurvinder Singh alias Palli son of Sarwan Singh, Jashanpreet Singh alias Tori son of Jaswant Singh resident of Chela Mor Colony Bhikhiwind, Amritpal Singh alias Amrit son of Milkha Singh resident of Johal Dhaewala and Jaswinder Singh alias Asu son of Tarsem Singh resident of Jamarai has formed a gang and by threating persons, are extroting money from the person and if they refuse to give money they carry out murders. Some time ago, they have fired in Munda village and Fatehabad town for extorting money. They are active members of an organized crime gang and have links with many anti-social elements based in Pakistan and they also smuggle illegal weapons in Tarn Taran and the surrounding areas by importing illegal weapons from Pakistan. Even today, they are armed with illegal foreign pistols and are sitting together for consultation near Rohi near Banka Baler Road to carry out some major incident. If the road is done now, all these foreign weapons can be caught and any major incident can be averted. The informant considered the above-mentioned persons as criminals and gave appropriate instructions and discharged them. This information is solid, reliable and credible, as per the information given by the informant, the crime is punishable under sections 111 BNS and 25, 25(6) 25(7)(1) 25(8)/54/59 of the IPC. Act is found to be in force, from which a copy of the Rukka Haja is being written and printed and the case of Senior Constable Satnam Singh 191/T.T. is being sent to the police station to be registered, the case should be registered and the case number should be informed and a special report should be prepared and sent to the service of the officers and the area magistrate and an e-mail should be given to the control room. I, ASI, inform my fellow employees about this information and leave for Barai Road.

The learned counsel for the petitioner-Amritpal Singh @ Amrit contends that pursuant to the arrest of the petitioner, a 32 bore pistol with 01 live cartridge has been recovered from him. There is absolutely no evidence available on record that he is connected to any known gangster. He further contends that his co-accused namely Gurwinder Singh @ Palli has already been granted the concession of bail by the Trial Court. As the petitioner is in custody since 20.10.2025 but none of the 09 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

The learned counsel for the petitioner-Veerpal Singh @ Golu @ Rajbir Singh Raja contends that as per the allegations, on the arrest of the petitioner, a 30 bore pistol with 02 live cartridges were recovered from his possession. There is absolutely no evidence of the petitioner being in touch with any known gangster. There are three cases registered against the petitioner.In two cases he was granted the concession of bail being a juvenile. As he is in custody since 19.10.2025 but none of the 09 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

The counsel for the State has filed separate replies dated 20.05.2026 which are taken on record. While referring to the same, he

contends that the petitioners are the associates of known gangster as mentioned in the FIR. The recoveries of illicit weapons have been effected from them. Therefore, they are not entitled to the concession as prayed for. He, however, concedes that the petitioners are in custody since 20.10.2026 and 19.10.2026 respectively but none of the 09 prosecution witnesses has been examined so far and that a co-accused namely Gurwinder Singh @ Palli has already been granted the concession of bail.

I have heard the learned counsel for the parties.

The veracity of the prosecution case against the petitioners shall be adjudicated upon during the course of the Trial. As they are in custody since 20.10.2025 and 19.10.2025 respectively but none of the 09 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioners is not required.

Thus, without commenting on the merits of the case, the present petitions are allowed and the petitioners, namely, Amritpal Singh @ Amrit (in CRM-M-6950-2026) and Veerpal Singh @ Golu @ Rajbir Singh Raja (in CRM-M-7258-2026) are ordered to be released on bail subject to their furnishing bail bonds and surety bonds each to the satisfaction of learned CJM/Duty Magistrate, concerned.

The petitioners shall appear before the police station concerned on the first Monday of every month till the conclusion of the trial and inform

in writing each time that he is not involved in any other case/crime other than the present one.

In addition, the petitioners (or anyone on their behalf) shall prepare an FDR in the sum of Rs.1,00,000/- each and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the petitioners from trial without sufficient cause.

These petitions stand disposed of.

The pending application(s), if any, shall stand disposed of accordingly.

A copy of this order be placed on the files of the connected petitions bearing No. CRM-M-7258-2026 titled as ‘Veerpal Singh @ Golu @ Rajbir Singh Raja versus State of Punjab’.
