The prayer in the present petition under Section 528 of the BNSS, 2023 is for issuance of directions to respondent Nos.1 to 3 to transfer the investigation of matters arising out of representations dated 11.07.2026, 21.07.2026, and 23.07.2026 (Annexures P-1 to P-3), as well as the assault incident dated 30.08.2024, to an independent agency like the Crime Branch, or otherwise constitute a Special Investigation Team (SIT).

The learned counsel for the petitioners contends that multiple representations have been made by the petitioners against the private respondents, but because they are affiliated with the ruling party in the State of Punjab, the Investigating Agency is taking no action on the said representations. Therefore, the inquiry into these representations be conducted by an independent agency like the Crime Branch or an SIT be constituted.

On the other hand, learned State counsel contends that the petitioners were part of the earlier management of a Gurdwara The private respondents are the incoming management. The dispute is regarding the management and affairs of the Gurdwara. At the instance of respondent No. 6, an FIR No.122 dated 02.09.2026 U/s 115(2), 126(2), 351(2), 191(3), 190 of BNS, 2023, P.S. Banur, Patiala, District Patiala already stands registered against the petitioners and others, in which the petitioners are absconding. The representations submitted by the petitioners are, therefore, devoid of any merit.

I have heard learned counsel for the parties.

Prima facie , the dispute appears to be between two factions interested in controlling and running the affairs of a local Gurdwara. An FIR No.122 dated 02.09.2026 U/s 115(2), 126(2), 351(2), 191(3), 190 of BNS, 2023, P.S. Banor, Patiala, District Patiala already stands registered against the petitioners at the instance of respondent No. 6, wherein the petitioners are absconding. If the petitioners are aggrieved in any manner, they are at liberty to avail their statutory remedies in accordance with law. At this stage, the prayer for entrustment of the inquiry/investigation to an independent agency does not arise.

In view of the above, I find no merit in the present petition. Therefore, the same stands dismissed.
