The instant petition has been filed for grant of regular bail to the petitioner in case bearing FIR No.136 dated 24.10.2024, registered under Section(s) (109 of BNS/307 of IPC), (3(5) of BNS/34 of IPC), (132 of BNS/353 of IPC), (324(4) of BNS/427 of IPC), (221 of BNS/186 of IPC), (111(2) (b) of BNS) and Sections 25,27 and 28 of the Arms Act registered at Police Station Sultanwind, Amritsar.

The case of the prosecution is that the petitioner along with co-accused Resham Singh alias Bau, had already been nominated in FIR No. 167 dated 19.10.2024 registered under Sections 125, 3(5), 324(4) of the BNS and Sections 25 & 56 of the Arms Act at Police Station 'A' Division, Amritsar. Acting upon secret information that both accused were planning to commit another offence, the police established a naka and conducted a search operation. 'A' Division, along with the police party, reached the spot and alighted from the government vehicle, both accused, who were allegedly hiding in nearby bushes, opened fire upon the police with the intention to kill them. The gunshots struck the left side of the government vehicle, whereupon the police retaliated in self-defence. During the exchange of fire, SI Narinder Kumar allegedly fired from his service revolver, causing a bullet injury to Gurwinder Singh alias Guri. Co-accused Resham Singh alias Bau initially fled the spot but was soon surrounded by the police party, surrendered, and was taken into custody.

Learned counsel for the petitioner contends that the FIR was initially registered against unknown persons and that no injury has been attributed to the petitioner in the present case. It is further submitted that the petitioner himself sustained injuries, and despite the alleged occurrence having taken place on a public road, no independent witness was associated with the investigation. Counsel further submits that the petitioner has been in custody since 24.10.2024 and has undergone actual custody of 01 year, 10 months and 11 days. It is also submitted that the co-accused has already been granted concession of regular bail by the Coordinate Bench of this Court in CRM-M72642-2025 dated 11.03.2026, therefore, prays for grant of regular bail.

Mr. Subhash Godara, Addl. Advocate General, Punjab accepts notice on behalf of the respondent-State. He has opposed the prayer for grant of regular bail on the ground that allegations against the petitioner are serious. He has filed the custody certificate of the petitioner in Court today, which is

taken on record. As per the custody certificate, the petitioner is in custody for the last 01 year 10 months and 11 days and is involved in other other criminal cases.

I have heard the submissions made by the parties and gone through the record.

Considering that the petitioner is in custody for the last 01 year 10 months and 11 days ; co-accused has been granted regular bail coupled with the fact that the trial is likely to take considerable time, this Court is of the view that no useful purpose would be served by further incarceration of the petitioner. Accordingly, the petitioner is granted the concession of regular bail during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

Nothing discussed hereinabove shall be construed as an expression of opinion on the merits of the case.

It is clarified that if while on bail so granted through the instant order, the petitioner is found indulged in any other criminal case/activity, it shall be open to the State to seek cancellation of his bail.
