The instant application has been filed seeking amendment of the present petition by incorporating therein the offence under Section 238 of BNS, 2023.

Learned counsel for the applicant-petitioners submits that initially the FIR was registered under Sections 115(2), 74, 76, 79, 351(3), 324(4),191(3) 190 BNS and later on added Section 117(2) of BNS. However, later on the offence under Section 238 of BNS, 2023 was added in the present FIR. Therefore, a prayer has been made that the present application be allowed and the amended petition be allowed to be placed on record.

Keeping in view the above, the present application is allowed. Amended petition is taken on record.

Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNSS’ ), is for grant of anticipatory bail to the petitioners, in case FIR No. 160 dated 14.7.2025, under Sections 115(2), 74, 76, 79, 351(3), 324(4), 191(3) 190 BNS, and later on added Sections 117(2) and 238 of BNS, registered at Police Station Patran, District Patiala.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. It is submitted the complainant, her husband and son were the aggressor party and they had come to the house of the petitioners and caused injuries to them. Moreover, the injuries allegedly inflicted on the person of complainant Heera Singh and Randeep Singh are simple in nature. Even, the medical evidence does not support the ocular version. Learned counsel further submits that vide order of even date passed in CRM-M-40500-2025, the similarly situated coaccused Varinder Singh @ Barinder Singh has been granted the concession of anticipatory bail by this Court.

Per contra , learned State counsel opposes the present petition. 4. Keeping in view the fact that vide order of even date passed in CRM-M-40500-2025, the similarly situated co-accused Varinder Singh @ Barinder Singh has been granted the concession of anticipatory bail. Therefore, the petitioners are also directed to join the investigation within a week. In the event of arrest, the petitioners shall be released on bail by the arresting/investigating officer on their furnishing bail/surety bonds to the satisfaction of the arresting/investigating officer, subject to the conditions as provided under Section 438(2) Cr.P.C. It is also directed that in case in future the petitioners are required to join the investigation process, thereupon they shall join the investigation and cooperate fully with the investigation

It is made clear that this order should not be treated as "blanket" order. It will not be read granting the petitioners indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

This order does not in any manner limit or restrict the rights or duties of the police or investigating agency to investigate into the charges against the petitioners.

¶27

The accused-petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him or her from disclosing such facts to the Court or to any police officer.

The accused-petitioners shall not leave India without prior permission of the Court.

The accused-petitioners shall join the investigation as and when called by the police.

It will be open to the police or the investigating agency to move to this Court for a direction under Section 483(3) of BNSS, 2023 (erstwhile Section 439(2) of Cr.P.C.) to arrest the accused-petitioners, in the event of violation of any term, such as absconding, non-cooperating during investigation, evasion, intimidation or inducement to witnesses with a view to influence outcome of the investigation or trial.
