T h rough the instant petition u nder Section 482 of the Bharatiya Na g arik Suraksha Sanhita, 2023 (for short ‘BNSS’), the petitioner see k s anticipatory bail in case FI R No.54 dated 17.04.2024 registered und e r Section 420, 120B of IPC at Police Station Nihal Singh Wala, District M oga.

Vide order dated 27.01.2026 p assed by this Court, the petitioner was released on interim bail a nd was directed to join investigation. H owever, he could not join the investigation and vide order dated 17.03.20 2 6, he was again directed to join the investigation.

L e arned State counsel on instructions states that the petitioner has joined the i nvestigation on 24.03.2026 and even challan has been filed. Learned State c ounsel has submitted that the c ustodial interrogation of the petitioner is no t required.

In view of the fact that the petit i oner has already joined the investigation a n d given the nature of allegatio n s, his pre-trial incarceration is not require d . As such, without commenti n g on merits of case, it is observed that a case for grant of anticipatory b ail is made out in favour of the petitioner. Accordingly, the petition is allowed and the order 27.01.2026 an d 17.03.2026 granting interim b a il to the petitioner is made absolute, subje c t to compliance of conditions l aid down in Section 482(2) of BNSS.
