Learned counsel for the p etitioner has submitted that th e petitioner has been falsely impli c ated in the present case and h e has no concern with the said o ff ence. He further submitted tha t t h e petitioner and his brothe r had availed loan from th e c o mplainant-bank and the pet i tioner had completed all th e r e quisite formalities with reg a rd to his loan, however, hi s brother is alleged to have not co m pleted the requisite formalitie s r e garding his loan. He arg u ed that both the loans ar e i n dependent and the petitioner c a nnot be held responsible for th e l o an of his brother, as such, th e ingredients of Section 318(4 ) B NS are not made out agains t the petitioner. Moreover, th e petitioner has clean antecedent s as he is not involved in an y other case. No recovery is to b e effected from him. Learne d c o unsel has further submitted t h at the petitioner is ready an d w illing to join the investigation as and when called upon to do s o b y the investigating agency.
