Th i s is the first petition under Se c tion 483 of the Bharatiya Nag a rik Suraksha Sanhi t a, 2023, for the grant of regula r bail to the petitioner in connec t ion with FIR No. 4 20 dated 21.11.2025, register e d under Sections 351(3), 191(3), 191(2), 190, 1 2 6, 118(1), 115 and 110 of the Bharatiya Nyaya Sanhita, 202 3 at Police Station U rban Estate, District Hisar, wh e rein subsequently Sections 11 7 (2) and 3(5) BNS w ere added, while Sections 191 ( 3), 191(2) and 190 BNS were l a ter deleted.

As per the case of the prosecuti o n, the petitioner Kanhiya @ P oni along with co-a c cused Shubham @ Tony and Sunil @ Sheelu gave beatings to the complainant. It is alleged that the petitioner a nd co-accused Shubham @ T o ny caused injuries on the head of the complainan t with an iron rod. It is further the case of the prosecution that wooden sticks w e re recovered from the roof of the house of the pe t itioner.

Le a rned counsel for the petitio n er has submitted that the injury inviting the off e nce under Section 308 IPC/B N S is not attributed to the petiti o ner and the injury a llegedly caused by the petitio n er is simple in nature. It is fur t her submitted that the matter has now been a m icably compromised between the parties.

However, Mr. Kunal Sharma, Ad v ocate appearing on behalf of the complainant-Su n ny, has filed power of attorne y and submitted that the matter has been compromised with the accused persons i n cluding the present petitioner a nd that the compl a inant has no objection if the p e titioner is released on bail. He has also placed on r ecord a copy of the affidavit f u rnished by the complainant-Su n ny, which reflects t h e amicable settlement arrived a t between the parties.

Wi t hout commenting on the meri t s of the case and keeping in v i ew the fact that the matter has been compromised b etween the parties, the affidavit of the complainan t has been placed on record and l earned counsel for the complai n ant has stated that h e has no objection if the petiti o ner is released on bail, and fur t her considering the fact that the petitioner is in cust o dy for the last about three mon t hs, this Court is of the opinion that no useful purp o se would be served by keeping the petitioner behin d bars any further.
