T hrough the instant petition filed under Section 482 of th e Bharatiya Na g arik Suraksha Sanhita, 2023 (f o r short “BNSS”), the petitioner s seek anticipat o ry bail in case FIR No.197 da t ed 29.11.2025, registered unde r Section 420 I P C, at Police Station Sadar Naw a nshahar, District SBS Nagar.

O n 21.01.2026, the following order was passed by the co - ordinate benc h of this Court: -

“Prayer in the present pe t ition, filed under Section 482 o f t h e BNSS, 2023, is for grant of a n ticipatory bail to the petitione r i n a case FIR No.197 dated 29.1 1 .2025, registered under Sectio n 420 IPC, at Police Station Sa d ar Nawanshahar, District SB S N agar.

Learned counsel for th e petitioner submits that th e petitioner has been falsely impli c ated in the present case only o n t h e allegation of conspiracy. It i s submitted that transfer of th e alleged money is not in the acc o unt of the petitioner but it is i n t h e accounts of the co-accused w h o are sons of the petitioner. H e f u rther submits that the petitioner has no criminal antecedent s and, thus, as no prima facie case is made out against th e petitioner, he deserves concessio n of anticipatory bail.

In the meantime, in the ev e nt of arrest, the petitioner shal l be released on interim bail su b ject to the satisfaction of th e A rresting Officer/Investigating O fficer. The petitioner shall joi n i n vestigation before the Investi g ating Agency/Officer. He shal l abide by the following conditions as envisaged under Sectio n 482(2) of the BNSS, 2023 (erstw h ile Section 438(2) of Cr.P.C.):(1) That the petitioner s h all make himself available fo r i n terrogation by a police officer a s and when required to do so. (ii) That the petitioner sha l l not directly or indirectly mak e any inducement, threat or promi s e to any person acquainted wit h t h e facts of the case so as to dis s uade him from disclosing suc h f a cts to the court or to any police officer.

(iii) That the petitioner sh a ll not leave India without prio r permission of the Court.”

L earned counsel for the petition e r submits that in compliance o f the order date d 21.01.2026 passed by the co- o rdinate bench of this Court, th e petitioner has j oined the investigation.

I n view of the statement made by learned State counsel, th e interim order d ated 21.01.2026 passed by the co-ordinate bench of this Court , is made abso l ute. The petitioner shall conti n ue to join investigation, as an d when called by the Investigating Officer and shall also abide by th e conditions as p rovided under Section 482(2) o f the BNSS.
