While granting interim bail to the petitioner on 22.12.2025,

this Court had specifically directed that petitioner shall surrender on 06.01.2026 by 5.00 P.M.

Order dated 22.12.2025 is reproduced here under:-

“1. Present petition has been filed by the petitioner, seeking grant of interim bail, in case, FIR No.111, dated 08.11.2024, under Sections 109, 191(3), 190, 351(3), 61(2) of BNS, and section 25 of Arms Act, 1959, registered at Police Station Division No.3, Police Commissionerate, District Ludhiana.

On 18.12.2025, following order was passed by this Court:-

“1. On a call given by the Punjab and Haryana High Court Bar Association, the Members of the Bar are abstaining from work w.e.f. 15.12.2025. Position is same even today.

In compliance to order dated 21.11.2025 of this Court, Pehrvi has filed the short affidavit dated 17.12.2025, of Mr. Inderjeet Singh Kahlon, Superintendent, New District Jail Nabha, in Court today, which is taken on record. Office to tag the same at appropriate place.

Let a copy of thereof be handed over to the opposite counsel during course of the day.

From paragraph No.4 of the aforesaid short affidavit, it is acknowledged that the attested medical certificate dated 04.11.2025, issued by Dayanand Medical College and Hospital, Ludhiana, which was submitted by the petitioner before this Court on the last date of hearing, has been received from Police Station Division No.03, Ludhiana, vide their letter dated 14.12.2025. However, as per the report of said Police Station, the petitioner was repeatedly called upon to appear at Dayanand Medical College and Hospital, Ludhiana for obtaining a fresh medical report, but petitioner failed to appear at the hospital. Due to the petitioner's non-appearance, the concerned Doctors could not give fresh medical report.

List again on 22.12.2025. To be shown in the urgent list.

Today, copy of letter dated 19.12.2025, forwarded by Dayanand Medical College and Hospital, Ludhiana, has been produced in Court by learned counsel for the petitioner, and the same is ordered to be taken on record.

As per the said letter, petitioner was again admitted to the hospital on 17.12.2025, considering the requirement of hospitalization for approximately 1–2 days.

Simultaneously, learned State counsel has produced the details regarding the admission and discharge of the petitioner from Dayanand Medical College and Hospital, Ludhiana, which are also ordered to be taken on record.

As per the details mentioned therein, petitioner was discharged from the hospital on 20.12.2025, i.e. two days ago.

Learned counsel for the petitioner submits that, considering the fact that a portion of the petitioner’s intestines has been surgically removed, he requires reasonable time to recover. Therefore, taking a sympathetic view, it is prayed that concession of interim bail be extended for a further period of two weeks.

However, the said prayer is opposed by learned counsel for the complainant, who submits that petitioner is a hardcore criminal and due to the injuries caused by him, one of the victims, namely Navjit Kaur, had to undergo removal of a kidney.

This Court has heard the submissions advanced by learned counsel for the parties and has also perused the record available before it.

Although it appears that petitioner may have played a serious role in the alleged crime, at this stage, this Court is not adjudicating upon the factual aspects of the case, but is only concerned with the petitioner’s health and recovery.

Considering the present medical condition of the petitioner and with a view to allow him sufficient time for recovery, this Court deems it appropriate to extend the concession of interim bail for a further period of two weeks.

Accordingly, interim bail already granted to the petitioner, namely Rishab Benipal alias Nannu, vide order dated 22.07.2025, by this Court, is ordered to be extended uptill 06.01.2026.

However, it is clarified that petitioner would surrender back to the concerned jail authorities on 06.01.2026 by 5.00 P.M.

However, it is clarified that immediately upon petitioner’s surrender to the jail authorities, the State shall get the health condition of the petitioner verified afresh, and a report in this regard shall be submitted before this Court on the next date of hearing.”

Today, learned State counsel has produced a letter dated 09.01.2026 addressed by Superintendent, New District Jail, Nabha, wherein it has been specifically stated that, in compliance with the directions issued by this Court, petitioner has not surrendered till 08.01.2026 at the jail gate, despite being required to surrender on 06.01.2026 by 5:00 P.M.

Learned State counsel, on instructions from ASI Mahinder, further submits that a police official visited the residence of the petitioner; however, the house was found locked.

In view of the aforesaid non-appreciable conduct of the petitioner, this Court finds no justification to proceed with the present

petition any further. Accordingly, present petition is dismissed.
