Quashing of FIR on the basis of compromise — Petition under Section 482 Cr.P.C. by Gurdeep Singh and others for quashing of FIR No. 101 dated 07.10.2020 (Sections 420, 467, 468 and 471 IPC, Police Station Bhadson, District Patiala) and consequential proceedings, founded on settlement agreement dated 06.02.2023. Pursuant to order dated 24.04.2024, statements were recorded and the Sub Divisional Judicial Magistrate, Nabha reported (report dated 23.12.2025) that the compromise was effected voluntarily and without coercion or undue influence; the factum of compromise was not disputed by the State or respondent No.2. Following the Full Bench judgment in Kulwinder Singh v. State of Punjab, 2007 (3) RCR (Criminal) 1052, as approved by the Supreme Court in Gian Singh v. The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No. 101 dated 07.10.2020 under sections 420, 467, 468 and 471 of the Indian Penal Code registered at Police Station Bhadson, District Patiala along with all consequential proceedings emanating therefrom, on the basis of settlement agreement dated 06.02.2023 (Annexure P-2).

This Court vide order dated 24.04.2024 had directed the parties to appear before the trial Court to get their statements recorded and the learned Magistrate was directed to send its report qua the genuineness of the compromise.

Pursuant to the aforesaid order, parties have appeared before the learned Sub Divisional Judicial Magistrate, Nabha and got their statements recorded. On the basis of the statements so recorded, learned Sub Divisional

Judicial Magistrate, Nabha has submitted copy of report dated 23.12.2025 to the effect that the compromise has been effected between the parties voluntarily and without any coercion or undue influence.

Learned State counsel as well as counsel for respondent No.2 have not disputed the factum of compromise between the parties. 5. In view of the above, no useful purpose would be served to continue with the proceedings before the trial Court in the instant FIR. 6.
