The jurisdiction of this Court under Section 483 BNSS has been invoked for grant of regular bail to the petitioner in case FIR No.162 dated 30.10.2025, under Section 3(5), 108 and 253 of BNS, registered at Police Station Bapoli, District Panipat.

The contents of the complaint, based on which the instant FIR was lodged, are reproduced hereunder:-

" A copy of the application is submitted respectfully to the Station House Officer, Police Station Bapoli, District Panipat. I, the applicant, Janeshwar Saini, son of Shri Kalluram Saini, resident of Village Bhatkhedi, P.O. Nagal, District Saharanpur, humbly submit as follows: My daughter Bharati Saini's marriage was solemnized in the year 2018 with Ravindra Saini, son of Jeetaram Saini, resident of Bapoli, Haryana, District Panipat. Today, on 30.10.2025, at approximately 2:30 PM, I received information that Bharati had committed suicide by hanging. When I arrived upon receiving this information, I came to know that my daughter Bharati had committed suicide by hanging herself because she was harassed/troubled by a boy named Shubham and a boy named Prakash. My daughter has written this information in her suicide note. I request that legal action be taken against the boys named Shubham and Prakash, and that justice be rendered to us. Sd"

Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in the instant FIR on the complaint made by the father of the deceased. Even the alleged suicide note is a manufactured document, which surfaced under mysterious circumstances. Moreover, the authorship of the same is also yet to be ascertained. It is further contended that there is no material on record to establish any instigation or abetment on behalf of the petitioner, inasmuch as there is no call detail record of the petitioner with the deceased have come on record. The petitioner, a 26 year old, has already undergone actual custody of 03 months and 29 days.

Custody certificate and status report by way of affidavit of Atma Ram, HPS, Deputy Superintendent of Police, Panipat-II filed by the learned State counsel are taken on record. Copy of the status report has also been furnished to the learned counsel for the petitioner. Learned State counsel has vehemently opposed the submissions made by the learned counsel for the petitioner and submits that there are specific and serious allegations against the petitioner, who, after his surrender before the learned JMIC, was made to join investigation, and upon finding incriminating evidence against him, he was arrested in the case. The petitioner got recorded his disclosure statement (annexed at Annexure R-6) in which he specifically admitted that he had secured unauthorized control over the Instragram account of the deceased by deceitfully obtaining her OTP, and invaded her privacy. Using her Instagram I.D., he monitored her personal communications, took screenshots of her private chats and used the same to blackmail and threaten her. submitted that due to continuous harassment and blackmailing by the petitioner, the deceased took the extreme step of committing suicide. A suicide note has also been recovered in the case, wherein specific allegations have been levelled against the petitioner, who is the main accused in the instant case. The FSL report is also awaited, and even the charges in the present case are yet to be framed. Therefore, the petitioner does not deserve to be granted the concession of regular bail by this Court.

Reverting to the case in hand, prima facie specific and serious allegations of gaining unauthorized access to the Instagram account of the deceased, and thereafter using her private chats to blackmail and harass her have been levelled against the petitioner. It is alleged that this continuous harassment by the petitioner led the deceased to commit suicide. Furthermore, charges are yet to be framed in the present case and the trial is still at the initial stage. Therefore, in view of the seriousness of allegations, prima facie the material on record and the nascent stage of trial, this Court is not inclined to extend the concession of regular bail to the petitioner. Therefore, the instant petition stands dismissed.
