Gurpreet Singh and Ors. Vs State of Punjab and Another

Petitioners seek quashing of FIR No. 0053 dated 31.05.2025 under Sections 118(2), 115(2), 126(2), 324(4), 324(5), 351(1), 191(3), 190 Bharatiya Nyaya Sanhita, 2023, Police Station Lambran, District Jalandhar Rural and all subsequent proceedings arising therefrom, on the basis of compromise dated 09.04.2026.

On 23.04.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise.

In compliance of the aforesaid order, parties appeared before learned JMIC, Jalandhar on 11.05.2026. Statement of Investigating Officer ASI Karnail Singh was recorded on 29.05.2026. Learned JMIC, Jalandhar

entered into a valid compromise without any influence or coercion. Pointwise report as under has been submitted:

“ 1. It is reported that as per the statement of complainant Narinder Singh @ Lali and accused persons namely Gurpreet Singh, Dharampreet Singh, Jaskaran Singh, Manish @ Sunny, Rahul @ Dholki and Sukhraj Singh @ Smile, the compromise has been effected in FIR No.0053 dated 31.05.2025, Under Sections 118(2), 115(2), 126(2), 324(4), 324(5), 351(1), 191(3) and 190 BNS, PS Lambra, Jalandhar (rural). From the statements of the parties it seems that the parties have entered into compromise is genuine, voluntary and without any coercion or undue influence. The said compromise seems to be genuine/correctness of the compromise and that the compromise is not the result of any fraud or misrepresentation and is the result of free will of the parties.

As per statement of ASI Karnail Singh in the present FIR there are six accused persons namely Gurpreet Singh S/o Narinder Singh, Dharmpreet Singh S/o Narinder Singh, Jaskaran Singh S/o Narinder Singh, Manish @ Sunny S/o Kamlesh Rai @ Dharamvir, Rahul @ Dholki s/o Hansraj and Sukhraj Singh @ Smile S/o Raghuvir Singh and there is no other accused in the present case apart from the above said accused persons.

3. It is further submitted that as per statement of ASI Karnail Singh the parties in the present case are not involved in other criminal case and are not declared as proclaimed offender in any other criminal case. No other criminal case is pending

against the accused nor they have been declared proclaimed offender in any case. ”

Learned State counsel has not raised any dispute regarding the factum of compromise between petitioners and respondent no.2.

Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility.

Following principles of law laid down by the Full Bench Judgment of this Court in “ Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “ Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303 , the petition is allowed.

FIR No. 0053 dated 31.05.2025 under Sections 118(2), 115(2), 126(2), 324(4), 324(5), 351(1), 191(3), 190 Bharatiya Nyaya Sanhita, 2023, Police Station Lambran, District Jalandhar Rural and all consequential proceedings arising therefrom, are quashed qua the petitioners.
