Instant petition has been filed under Section 528 of BNSS, seeking quashing of the below detailed First Information Report (FIR), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 24.03.2026(P-2), effected between the parties.

Vide order dated 17.04.2026, the affected parties were directed to appear before the learned Trial Court/Illaqa Magistrate, for getting their respective statements recorded with regard to the compromise.

Report has since been received from learned Judicial Magistrate First Class, Dera Bassi, in pursuance to the directions of this Court wherein, the factum of the compromise arrived at between the parties stands verified and confirmed. As per the report(s) compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the private respondents have also made statement to the effect that they would have no objection if the FIR qua the accused-petitioners is quashed.

The trial Court has annexed the statements of the parties in original, along with its report. The relevant part of the said report is reproduced herebelow:

Learned counsel for the petitioner submits that petitioner is

the only named accused in the FIR in question, and that the private respondent is complainant/aggrieved party therein.

Learned State counsel does not dispute the aforesaid factual position and affirms the same during the course of arguments.

In view of the report of the learned Judicial Magistrate First Class, Dera Bassi, and the principles laid down by Hon’ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052 , the instant petition is allowed. The aforesaid FIR and all consequential

proceedings arising out of it, are quashed.

Needless to say the parties shall remain bound by the terms of compromise and their statements recorded before the Court below 9. Petition stands disposed of.

i) Present application has been filed under Section 528 of BNSS read with Section 482 Cr.P.C. seeking issuing a fresh direction for quashing of DDR No. 21 dated 24.10.2024, under Section 331(6) of BNS registered at Police Station Lalru, SAS Nagar Mohali in view of the earlier direction issued vide order dated 17.04.2026 (P-9).

ii) Since the FIR and all consequential proceedings arising out of the same occurrence already stand quashed vide order of even date, present application has been rendered infructuous.

iii) Accordingly, present application is disposed of as having been rendered infructuous.
