Present petition has been fil e d under Section 482 of th e Bhartiya Na g arik Suraksha Sanhita, 2023 ( for short ‘BNSS’) for grant o f concession o f anticipatory bail to the petiti o ner, in case FIR No.110 date d 15.10.2025, u nder Sections 118(1), 118(2), 1 15(2), 190, 191(3) of the BNS , 2023, at Police Station Samalsar, District M o ga.

On 30.04.2026, the following o r der was passed:

“ Inter alia, contends that the p etitioner has been falsely implicate d into the FIR in question, assumin g arguendo, the prosecution versio n available at this juncture is taken to b e correct, the injury attributed to th e p etitioner is simple in nature, the p e titioner is a man aged 28 years an d sole bread earner of his family, the p etitioner has no criminal antecedent s and sending him to custody only c au se ignominy to the petitioner & th e p etitioner is willing to join investiga ti on and cooperate therein.

Status report by way of affidavit of Dalbir Singh, PPS, Deputy Superintendent of Police, Baghapurana, District Moga, has been filed in Court today. The same be kept on record. Copy thereof has been furnished to learned counsel for the petitioner.

The petitioner is directed to appear before the Investigating Officer on 5.5.2026 at 11:00 A.M. in concerned Police Station and join investigation. In the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. He shall abide by the condition(s) enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. ”

Learned State counsel (on instructions) has stated that pursuant

to the order dated 30.04.2026, the petitioner has joined investigation and his custodial interrogation is not required.

Having heard learned counsel for the parties and upon perusal of the record; especially in view of the factum of the petitioner having joined investigation and his custodial interrogation is not being sought for by the State; the interim order dated 30.04.2026 passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS, 2023.

Petition stands allowed , accordingly.

This order should not be treated as “blanket” order. It will not be read as granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS, 2023 or upon showing any other sufficient cause.
