T his is a petition filed under S ection 528 Bharatiya Nagari k Suraksha Sa n hita (BNSS), 2023, for qu a shing of FIR No.275, date d 28.08.2025, u nder Sections 318 Bharatiya N yaya Sanhita, 2023, at Polic e Station City H oshiarpur, District Hoshiarpur (Annexure P-2) and subsequen t proceedings a rising therefrom on the basis o f compromise dated 15.01.202 6 (Annexure P- 1 ).

T his Court vide order dated 27. 0 2.2026 had directed the partie s to appear bef o re the Illaqa/Duty Magistrate t o get their statements recorde d and the learned Magistrate was directed to se n d its report qua the genuinenes s of the compro m ise.

P ursuant to the aforesaid order, p arties have appeared before th e Chief Judicia l Magistrate, Hoshiarpur and g o t their statements recorded. O n the basis of t h e statements so recorded, Chie f Judicial Magistrate, Hoshiarpu r has submitted report dated 17.03.2026 to the effect that the compromise ha s been effected between the parties voluntaril y and without any coercion o r undue influen c e.

L earned State counsel as well a s counsel for respondent No. 2 have not disp u ted the factum of compromise b etween the parties. 5. I n view of the above, no usef u l purpose would be served t o continue with the proceedings before the trial C ourt in the instant FIR. 6. F ollowing the principles laid do w n by the Full Bench judgmen t of this Court in Kulwinder Singh and others Versus State of Punjab and another 2007 (3) RCR (Criminal) 1052 and approved by the Hon’ble Supreme Court in Gian Singh Versus State of Punjab and others (2012) 10 SCC 303 , thi s petition is allowed and FIR N o.275, dated 28.08.2025, unde r Sections 318 Bharatiya Nyaya Sanhita, 2 023, at Police Station Cit y Hoshiarpur, D istrict Hoshiarpur (Annexure P-2) and subsequent proceeding s arising theref r om on the basis of compromise dated 15.01.2026 (Annexure P - 1) are quashe d .
