Th e instant petition has been filed by the petitioner under Sectio n 482 of Bharatiy a Nagarik Suraksha Sanhita, 20 2 3 (for short “BNSS”) for gran t of regular bail i n case arising out of FIR No.20 dated 23.01.2026 registere d under Sections 3 18(4), 336(2), 336(3), 340(2) and 61(2) of Bharatiya Nyay a Sanhita, 2023 ( f or short “BNS”) at Police S t ation Canal Colony, Bathinda , District Bathind a .

Th e aforementioned FIR has bee n registered on the basis of a written complai n t submitted by the complainan t Jasvir Yadav, an employee o f CNH Industrial Capital India Private Limited a lleging therein that the presen t petitioner along w ith his brother Harpreet Singh had availed 02 loan facilities i n the sum of Rs. 8 ,53,972/- and Rs.8,85,774/- r e spectively for the purpose o f purchase of trac t ors. They had submitted docu m ents of their identity proof lik e PAN card, aadh a r card etc. to avail the loan fa c ilities. The petitioner was als o made a co-appli c ant in the loan availed by the accused Harpreet Singh. Afte r availing the loa n amount, the petitioner and th e co-accused did not deposit th e instalments ther e of. On making inquiries, it ha d transpired that on the basis o f false documents of identification i.e. PAN ca r d and aadhar card by wrongl y showing their a ddress, they had availed loan facilities from other financia l institutions also and had cheated them. They a lso misappropriated the tractor s purchased after availing the loan amount. A ll this was done by them i n connivance with co-accused Varinderjit Singh, a n official of the company of th e complainant.

Aft e r registration of FIR, investigation proceedings have bee n initiated and ar e underway. Apprehending his arrest, the petitioner moved a n application for g rant of anticipatory bail which h as been dismissed by the Cour t of Learned Addi t ional Sessions Judge, Bathinda vide order dated 07.02.2026.

It i s argued by learned counsel fo r the petitioner that he has bee n falsely implicat e d in this case. No amount of loan was ever disbursed by th e complainant to h im at any point of time. No d o cument was ever submitted b y him to avail an y loan. The case is based on d o cumentary evidence and all th e

requisite docum e nts are already with the inves t igating agency. He is ready t o join investigati o n. His custodial interrogatio n is not required. Neither an y recovery is to b e effected from him. It is, ther e fore, argued that he deserves t o be extended ben e fit of bail.

Per contra, learned State counsel as s isted by learned counsel for th e complainant wh o has also placed on record cert a in documents and while relyin g upon the status report has vehemently argued that the allegations against th e petitioner are se r ious and specific in nature. T he complainant and his brothe r had availed lo a n facilities from the company of the complainant thereb y executing docu m ents undertaking to repay the s a me in instalments but not eve n a single instalm e nt had been paid. Documents o f their identity had been forged . During scrutiny of those documents variations i n the date of birth as mentione d in the aadhar c a rd and PAN card were found. Other discrepancies were als o noticed. It was revealed that forged KYC do c uments had been furnished i n connivance with one official of the financial ins t itution. The allegations that th e petitioner did n o t avail any loan facility are p rima facie false as the tracto r purchased on t h e basis of the said loan had been got issued by him an d photograph An n exure R1 showed this fact. L earned State counsel has als o placed on reco r d Annexure R2 which is GST invoice issued by Gurkirp a Automobiles re g arding sale of tractor as on 04. 0 3.2025. The documents of loa n have also been placed on record by the learned c ounsel for the complainant. Hi s custodial interr o gation is required for con d ucting proper and thoroug h investigation. arrest bail to th e petitioner. It is, therefore, a r gued that the petition does no t deserve to be all o wed.

Thi s Court has heard the rival sub m issions made by learned counse l for the parties at considerable length.

Th e petitioner is alleged to have d u ped the complainant by availin g loan facility on the basis of forged docume n ts and has not deposited an y instalment ther e after. The allegations prim a facie make out a case fo r commission of s ubject offences by the petition e r. The allegations against hi m are serious in n ature. The case is at its nascent stage. It is well settled tha t anticipatory bail to an accused can be granted i n exceptional circumstances onl y as a person cou c hed in comparative safety of pr e -arrest bail would certainly no t disclose all the fa cts within his knowledge. In c a se custodial interrogation of th e petitioner is de n ied to the Investigating Agenc y , that shall leave many glarin g loopholes and g a ps, thereby adversely effectin g the investigation. The Court i s also required to see that an order of anticipator y bail does not operate as inroa d in the normal l e gal procedure of criminal cas e s by the trial Court. It is wel l settled propositi o n of law that the powers for g rant of pre-arrest bail are to b e exercised by the Court in extra-ordinary and exceptional circumstances and wit h great caution w h ile taking into consideration the nature of the accusation and th e sentence which the conviction may entail. In the instant case, no suc h exceptional or e x tra-ordinary circumstance is, h o wever, made out from the plea s as taken by the petitioner. consideration th e above discussed facts, this C o urt is of the considered opinio n that the petition d eserves to be dismissed. Accor d ingly the same is dismissed.
