The pres e nt appeal has been filed aga i nst the impugned order date d 25.05.2026 whereby, his application for grant of regular bail had bee n dismissed by learned Additional Sessions Judge, Special Court, Faridabad in a crim i nal case arising out of First Information Report as detaile d hereinunder:-

In the mont h of Nove m ber 2023, he invited her to m eet him at Shri Shyam Bab a Market a n d she went there to meet him. words, sh e went to hotel, where he mixed something in her cold drink an d forcibly e stablished physical relations w ith her and also clicked he r obscene p hotos/videos and said that if s h e disclosed this to anyone, h e would m a ke viral the photos/videos an d also given threat to kill he r family m e mbers. Due to threat and insul t , she did not disclose about th e alleged i n cident to anyone. In the mont h of December 2023, he agai n called he r in the same hotel by givi n g threat to viral her obscen e photos/vi d eo and committed rape with h er. Krishan Thakur and othe r persons w ere making calls and mess a ges for establishing physica l relations/ p hysical exploitation and due to w hich, she disclosed all inciden t to her par e nts.

After reg i stration of this case, investig a tion was conducted. Site pla n depicting the place of occurrence was prepared. The victim was go t medico-le g ally examined. Her statement under Section 183 BNSS wa s also got recorded. The appellant was arrested on 20.11.2024. Th e appellant was also medico-legally exa m ined. One mobile phone mak e Realme w as got recovered from the a p pellant. On 04.12.2024, cast e certificate of the victim was got verified a n d thereafter, Section 3(2)(V) o f SC/ST A c t was added. The mobile phon e which was got recovered fro m the appell a nt deposited in DITAC Gurug r am. The date of birth certificat e of the vi c tim was also obtained from the school where she studied . Statement of witnesses were recorded. A f ter completion of investigation , challan w a s presented against the appella n t.

Learned c ounsel for the appellant submitted that the present appellant i s in custod y since 20.11.2024, since the da y of his arrest. The statement o f

the victi m had already been recorded. L earned trial Court erroneousl y dismissed the bail of the appellant for grant of regular bail. He als o submits t h at the appellant is also involved in three other cases but he is o n bail on th o se cases.

Learned S tate counsel while relying upon the previous status report date d 05.08.2026 and the compliance report d ated 08.09.2026 filed in Cour t today, ha s submitted that the victim in h er statement under Section 18 3 BNSS as w ell as her statement recorded before the learned trial Court ha d specifical l y corroborated the allegations against the appellant. It is als o submitted that the present appellant has c o mmitted the penetrative sexua l assault wi t h the victim and click her obsc e ne photographs and videos an d threatene d her he would make those p hotographs and videos viral . Therefore , he is not entitled for grant of r e gular bail.

As per th e compliance report dated 08.0 9 .2026, the present appellant i s involved in three other cases, detail of wh i ch is as under:-

The appe l lant is on bail in those case a n d the cases are at the stage o f prosecuti o n evidence. In the present ca s e, mobile of the appellant ha d already b e en handed over to the Polic e and the report from DITAC , Gurugra m is still awaited. The statement of the victim had already bee n recorded. The remaining prosecution witn e sses to be examined against th e appellant w ho are official witnesses and t here is no chance of their bein g influence d by the present appellant. The completion of trial against him i s likely to t ake time. Therefore, without c o mmenting on the merits of th e case, this Court is of the view that the a p pellant deserves the concessio n of interim pre-arrest bail. 8. Accordin g ly, the instant appeal is allowe d , and the appellant is ordered t o be releas e d on regular bail on furnis h ing bail/surety bonds to th e satisfaction of the learned trial Court/ D uty Magistrate, subject to th e following conditions:-

(i) The appellant shall no t leave the country without prior

permission of the trial C ourt and shall deposit the

passport in the trial C ou rt.

¶34

(ii) The appellant will not t amper with the evidence durin g the trial.

¶35

(iii) The appellant will no t pressurize/ intimidate the prosecution witnesses.

(iv) The appellant will ap p ear before the trial Court on each and every date fi x ed, unless is exempted by a specific order of Cour t.

(v) The appellant shall no t commit an offence similar to the offence of which, h e is an accused, or for commission of which h e is suspected of.

(vi) The appellant shall no t directly or indirectly coerce, induce, threaten or pr om ise to any person acquainted

with the facts of the c as e so as to dissuade him/her from disclosing such fa cts to the Court or to any polic e officer or tamper with t he evidence in any manner.

(vii) The appellant shall n ot in any manner misuse his liberty.

¶43

(viii) The appellant shall fu rn ish his address and mobile number to the Trial C o urt forthwith and shall not change the same till t he conclusion of the trial and in case for any reason, t he appellant seeks to change any of the aforesaid, the s am e shall be done only with prio r intimation to the learn e d Trial Court, stating the reaso n for the same.

(ix) The trial Court/Duty M agistrate may impose any othe r condition, as deemed ap propriate while releasing the appellant.

9 It is ma d e clear that in case there i s any breach of the aforesai d condition s , the State shall be at liberty to seek cancellation of bail a s granted to the appellant by this order.

In view o f the above, it is clarified that t h e observations made herein ar e limited fo r the purpose of present proceed i ngs and would not be construe d as an op i nion on the merits of the ca s e and the trial would procee d independ e ntly of the aforesaid observatio n s.
