The present application has been filed under Section 528 of BNSS (Section 482 Cr.P.C) for placing on record the testimony of complainant/respondent No.2 as Annexure A-12.

The above-numbered criminal appeal had been registered on the basis of a complaint moved by the complainant/victim stating that she belongs to the Chamar caste and the petitioner belongs to the Jat caste and are her brother-inlaw and sister-in-law; that she performed an inter-caste marriage with Rxx Mxxx; that her husband is not residing with her and, on the instigation of the accused persons, her husband gave beatings to her. She further stated that on 16.12.2025 at about 12:30 PM, she called Mistry Gurmeet to repair the gas geyser and, after repairing the gas geyser, when he was leaving the house, the accused persons came and snatched the tools of the said Gurmeet, which she then returned after taking them from the accused. She further stated that at about 02:00 PM, when she, along with her mother, was going to take medicine, the accused persons came and accused Kashmiri touched her with bad intention and also gave beatings to her and her mother; that they also hurled abuses at them and used derogatory words publicly; that they also extended threats to kill her; that she got herself medico-legally examined and her husband wanted to shunt her out of her matrimonial home. She further stated that the entire incident had been recorded in the CCTV camera and requested that action be taken against the culprits. On this complaint, a formal FIR was registered.

After registration of the FIR, investigation was conducted. The statement of the

caste certificate of the victim was taken into police possession. The victim was medico-legally examined. After completion of the investigation, the challan was presented against the appellant and he was duly charged.

Learned counsel for the appellant submits that the statement of the victim has since been recorded by the learned trial Court. The allegations against the appellant are that he used to touch the victim inappropriately with bad intention. The allegations against the appellant are subject matter of trial. She further submits that the petitioner never indulged in any offence as alleged against him. In fact, the victim/complainant and the appellant and others had a civil dispute because the victim/complainant has filed Civil Suit No.1809 of 2025 against the appellant. Along with the civil suit, she also moved an application for grant of ad-interim maintenance. Her application had since been dismissed vide order dated 03.11.2025 (Annexure A-2). She prayed that the appellant be released on regular bail, as the conclusion of the trial is likely to take some time.

Compliance report by way of affidavit of Sushil Parkash, HPS, DSP (Crime) Kaithal on behalf of the respondent-State has been filed in Court today and the same is taken on record. Copy thereof has been supplied to the counsel opposite.

Learned State counsel as well as counsel for respondent No.2 oppose the bail application on the ground that, in view of the seriousness of the allegations levelled against the appellant, he is not entitled to the concession of regular bail.

I have heard learned counsel for the parties and perused the documents on record.

The appellant is brother-in-law of the victim. The statement of the victim has since been recorded by the learned trial Court. The allegations against the appellant are subject matter of trial. The conclusion of trial is likely to take some time. Therefore, no fruitful purpose would be served by detaining the appellant in

further custody. As such, sufficient mitigating circumstances are made out to extend the concession of regular bail to the appellant.

Accordingly, the instant petition is allowed, and the appellant is ordered to be released on regular bail on furnishing bail/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate, subject to the following conditions:-

(i) The appellant shall not leave the country without prior permission of the trial Court and shall deposit the passport in the trial Court.

(ii) The appellant will not tamper with the evidence during the trial. (iii) The appellant will not pressurize/ intimidate the prosecution witnesses.

(iv) The appellant will appear before the trial Court on each and every date fixed, unless is exempted by a specific order of Court.

(v) The appellant shall not commit an offence similar to the offence of which, he is an accused, or for commission of which he is suspected of.

(vi) The appellant shall not directly or indirectly coerce, induce, threaten or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer or tamper with the evidence in any manner.

(vii) The appellant shall not in any manner misuse his liberty.

(viii) The appellant shall furnish his address and mobile number to the Trial Court forthwith and shall not change the same till the conclusion of the trial and in case for any reason, the appellant seeks to change any of the aforesaid, the same shall be done only with prior intimation to the learned Trial Court, stating the reason for the same.

(ix) The trial Court/Duty Magistrate may impose any other condition, as deemed appropriate while releasing the appellant.

It is made clear that in case there is any breach of the aforesaid conditions, the State shall be at liberty to seek cancellation of bail as granted to the appellant by this order.

In view of the above, it is clarified that the observations made herein are limited for the purpose of present proceedings and would not be construed as an opinion on the merits of the case and the trial would proceed independently of the aforesaid observations.
