Civil Revision (CR-4365-2026 O&M), decided 29.05.2026 by Harkesh Manuja J.: Petitioners/landowners sought a direction to the learned Executing Court for expeditious disposal of their execution petition for disbursement of land acquisition compensation. Interim orders dated 26.05.2026 and 27.05.2026 recorded HSIIDC's failure to furnish calculation details of market value and benefits under Sections 23 1-A and 23 (2) of the Land Acquisition Act, 1894, leading to costs of Rs.1,00,000/- being saddled on two HSIIDC officers for deliberate delay in disbursement, with a direction that the Managing Director, HSIIDC remain present in case of default. Upon a detailed calculation sheet being produced on 29.05.2026 with an assurance to file it before the Executing Court, the Court waived the costs, disposed of the petition, and requested the Executing Court to decide the execution petition expeditiously, preferably within the next 30 days from the date fixed.

By way of present revision petition, prayer has been made for issuance of direction to the learned Executing Court for expeditious disposal of execution petition.

tomorrow i.e. 27.05.2026 through Sh.Ashok Yadav, Engineering Incharge of Dharu hera, and copy thereof shall be furnished to the learned counsel for the petitioners in Court on the next date of hearing in the present proceedings.

In terms thereof, a calculation sheet, duly signed by Ms. Arti Bansal, Manager (Legal), HSIIDC and Mr. Deepak Saini, Advocate, has been handed over in Court today, the same is taken on record as Mark ‘X’.

A perusal thereof shows that no details whatsoever have been provided in the said calculations with respect to the amount of market value, benefits under Sections 23 1-A and Section 23 (2) of the Land Acquisition Act, 1894, (for short ‘the 1894 Act’) or even the date on which the amount under the original award was released in favour of the petitioners/ landowners. Similar is the position with respect to the calculations made in terms of the decisions rendered by the learned Reference Court, this Court or even by the Hon’ble Apex Court.

In such circumstances, it appears that the respondents are deliberately and consciously delaying to disburse the compensation in favour of the petitioners/ landowners. The above said calculations have been handed over by Ms.Arti Bansal, Manager (Legal), HSIIDC, who is present in Court, and the same were, in turn, provided by Mr. Ashok Yadav, AGM Engineering, HSIIDC, and Ms.Pooja Batra, AGM, Accounts, Field Office, Babal.

In the wake of above, the above said two officers i.e. Mr. Ashok Yadav, AGM Engineering, HSIIDC, and Ms.Pooja Batra, AGM, Accounts, Field Office, Babal, are saddled with costs of Rs.1,00,000/- to be paid in equal shares to the petitioners from their own pocket on next date of hearing.

Ms.Arti Bansal, Manager (Legal), HSIIDC, prays for a day’s time to provide correct calculation sheet before this Court.
