In a civil suit, the defendant summoned an official witness (Assistant Officer, Service Tax) to prove bills issued by the plaintiff to the defendant. The witness defied the summons and opted not to appear; the Trial Court thereupon punished the defendant-petitioner and ordered closure of his evidence. Held, allowing the revision: where the party has discharged its obligation and the summons stands executed, the court cannot punish the party for the witness's defiance; the correct course is to compel the witness's attendance through bailable/non-bailable warrants rather than close the party's evidence. Any objection to the relevance of the witness's testimony is to be raised at the time of the witness's examination.
