Civil Suit No.516 of 1996, �tled as “Local Gurudwara Prabandhak Commi�ee v. Randhir Singh and others”, for possession of the property in dispute was decreed ex parte on 11.07.2014 by learned Addl. Civil Judge (Sr. Divn.), Payal. In order to implement the said decree, execu�on No.207 of 2014 is pending before learned Addl. Civil Judge (Sr. Divn.), Payal.

As has been pointed out before this Court that an applica�on under Order 9 Rule 13 CPC was moved for se7ng aside the ex parte judgment and decree, which was dismissed by the trial Curt on 18.12.2023.

The appeal against that order is now pending before learned Addl. District Judge, Ludhiana. In the mean�me, since warrants of possession were issued by the Execu�ng Court, so these revision pe��ons have been filed. It is also informed that regarding the same property, different civil appeals bearing Nos.CA-67 of 2024 and CA-606 of 2025, are pending before the same Addl. District Judge, Ludhiana.

A=er hearing learned counsel for the par�es, both the revision pe��ons are hereby disposed of with a direc�on to the concerned learned Addl. District Judge, Ludhiana to dispose of the aforesaid appeals, i.e. CA67 of 2024 and CA-606 of 2025, expedi�ously, preferably within six months posi�vely, to be specific, on or before 31.07.2026. If due to any reason, the Appellate Court is unable to dispose of these appeals up to 31.07.2026, extension shall be taken from this Court, by ci�ng the reasons for nondisposal of the appeals.

It is further made clear that none of the observa�ons made by this Court in any of these two revision pe��ons, shall influence the Appellate Court, while disposing of the appeals on their own merit. Till the disposal of the appeals by the First Appellate Court, the execu�on proceedings shall remain stayed.
