seeking transfer of the civil suit for damages i.e. CS-211-2022, titled “ Gurvinderjit Kaur v/s Navjot Kaur ” filed by the respondent, pending in the courts at Patiala and she seeks transfer of the same to the courts at Payal, District Ludhiana.

It is submitted by the counsel for the applicant that there is matrimonial dispute between the applicant with her husband, Gurwinder Singh and on this account, there is multiple litigation with the respondents and their family. Similar suits for seeking damages i.e. CS/1080/2019 and CS/2432/2022, were filed by the brother of the husband of the applicant. The transfer applications i.e TA-975-2024 and TA-1009-2024, were filed, relating to transfer of both the aforesaid civil suits, as a result whereof, the said transfer applications, were accepted and both the said civil suits were transferred, vide order dated 26.08.2025, passed by this court. Also, it is submitted that the divorce petition, filed at the instance of Guwinder Singh, was also transferred, on the basis of the transfer application i.e. TA-9842024, vide the aforesaid order. In the light of the same, it is submitted that the civil suit, has been filed at the instance of the sister of the husband of the applicant.

Counsel for the respondent, at this stage, states that in view of the major portion of the litigation, having been transferred from Patiala to Payal, already, as submitted by the counsel for the applicant, she has no objection if the present application, as such, is hereby allowed and the civil suit filed by the sister of the husband of the application, for seeking damages, is also transferred to the courts at Payal. However, she made a prayer that since the respondent is also a lady, whose son is about 3 years old, she may be permitted to make appearance before the court, through video conferencing.

In view of the submissions made by the counsel for the respondent, this court while dealing with the transfer roster, cannot give any

such direction to the court, where the case is pending, to allow the respondent to make appearance through video conferencing. But any how, the respondent always has the option to file an application before the court concerned, who shall pass an appropriate order, in the fitness of the circumstances.

In the light of the aforesaid and also taking into consideration the order dated 26.08.2025, vide which three transfer applications, relating to the litigation by the in-laws’ of the family of the applicant, already stands transferred to Payal from Patiala, the present transfer application is hereby allowed and the civil suit for damages i.e. CS-211-2022, titled “ Gurvinderjit Kaur v/s Navjot Kaur ” filed by the respondent, stands transferred from the Courts at Patiala, to the Court of competent jurisdiction at Payal, District Ludhiana. The requisite record of the aforesaid case be sent by the court concerned, to the District and Sessions Judge, Ludhiana.

Learned District and Sessions Judge, Ludhiana, shall assign the said petition to the Court of competent jurisdiction at Payal. Even, the parties are directed to appear before the concerned court, within a period of one month from today onwards.
