��-��% ��# ��t is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 02.05.2022. However, on account of the matrimonial dispute, the parties are residing separate. One son born from this marriage, who is about 2½ years old, is in the care and custody of the applicant. The applicant is not having any source of earning and as such, is dependent upon her parental family. Even, she has filed the petition under Section 125 Cr.P.C., which is pending in the Courts at Rohtak and the respondent is pursuing the said petition. Besides the same, the applicant has also filed the petition under Section 13 of the Hindu Marriage Act, which is also pending in the Courts at Rohtak, at appearance stage. The distance between the two places is stated to be about 70 kms.

Considering the submissions aforesaid, more particularly, taking into consideration the fact of the applicant taking care of the minor son, while herself not having any source of earning, the fact of other two litigations, arising from the matrimonial dispute, already pending in the Courts at Rohtak and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and�� !
