The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/422/2024, titled ‘Balraj Singh Vs. Navneet Kaur’, filed by the respondent-husband, pending in the Family Court (Camp Court) Batala, District Gurdaspur and she seeks transfer of the same to the Court of competent jurisdiction at Amritsar.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 29.01.2022, but no child was born from the said wedlock. On account of the matrimonial dispute, the parties are residing separate. The applicant is a B.Tech. graduate. On account of this matrimonial dispute, the applicant has got lodged an FIR bearing No.7 dated 06.02.2024, under Sections 406 and 498-A IPC, at Women Police Station, District Amritsar, wherein challan has been presented and the respondent has joined the proceedings. In the said case, charges are yet to be framed. Also, it is submitted that the applicant is not having any source of earning and as such, she has filed the petition under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which is pending in the Courts at Amritsar. Besides the same, she has also filed the petition under the Protection of Women from Domestic Violence Act, which is also pending in the Courts at Amritsar and the respondent is pursuing the same. Furthermore, it is submitted that the respondent himself is Vice Principal in Shri Guru Ram Dass Group of Institute, Pandher, Fatehgarh Churian Road, Sangatpura, Near Mahadipur Chowk, Amritsar and he is residing in Amritsar.

Keeping in view the facts and circumstances, as pointed out aforesaid and considering three cases already pending against the respondent, in the Courts at Amritsar, more particuarly, the criminal case, wherein the respondent is making appearance and also considering the fact of the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/422/2024, titled ‘Balraj Singh Vs. Navneet Kaur’,
