On the last date of hearing, the following order was passed:-

“Learned counsel for the parties submit that they are not in touch

with their clients and accordingly, notice be issued to them.

Let notice be issued to the parties to the instant appeal for 25.02.2025.”

As per the report of the Registry, the appellants were not available at the time of service. Respondent No.1 is stated to have expired. Respondent No.2 was served and respondents No.3 and 4 have been served through their sister-in-law, whereas, respondent No.5 was served through his wife. However, no one has put in appearance on behalf of respondents No.2 to 5.

Since the appellants have not contacted their counsel and even most of the appellants have not appeared now despite service, it appears that they are no longer interested in pursuing the present appeal.

That being so, the appeal is dismissed for non-prosecution. However, liberty is granted to the appellants to move an appropriate application for revival of the appeal in case they are interested in pursuing the

same.
