By way of present appea l , challenge has been laid to an award d a ted 03.10.1997 passed by the Court of learned Additional District J udge, Rupnagar-cum-reference Court, whereby, refere n ce petition filed at the instance of a ppellants-landowners see k ing enhancement of compensation was p a rtly allowed. 2. Briefly stating, certain land owned by the landown e rs, situated within the revenue estate of Village Mataur, the then Te h sil Kharar, District Rupnagar came to be acquired vide notificati o ns dated 0 9 .08.1991 and 28.09.1992 is s ued under Sections 4 and 6 of the Lan d Acquisition Act, 1894 (her e inafter referred to as 'the A ct') respecti v ely for the purpose of setting up of Urban Estate. No.446 dated 31.08.1994 was pa s sed by the Land Acquisi t ion Collecto r , for short ‘the LAC’, awar d ing compensation at a unif o rm rate of Rs.1,60,000/- per acre. 3. Being dissatisfied, the respondents/landowners filed Referen c e Petition under Sectio n 18 of the Act, see k ing compen s ation at the rate of Rs. 10 , 000/- per square yard besi d es other st a tutory benefits. The Refe r ence Court vide award dated 03.10.1 9 97 accepted the claim made by the respondents-landowners in part a nd enhanced the market v alue to Rs.4,06,000/- per acre along w i th other statutory benefits and interest. Aggrieved of the determi n ation made by the learned R eference Court, the State filed the pres e nt appeal.

I have heard learned co u nsel for the parties and g o ne through t he paper-book.

The appeal in hand is squ a rely covered by the outcom e of RFA No.2505-1997, titled as Amar Singh and ors. Vs. State of Punjab , decided on 10.07.2024, whe r eby the market value pertaining to the s a me notification dated 09.08. 1 991, issued under Section 4 of the Act for the revenue estate of V illage Mataur, the then Te h sil Kharar, D istrict Rupnagar, was enhanced to Rs.6,08,744/- in fav o ur of the cl a imants/ landowners. The r e levant paragraph No.7 of Amar Singh’s case (supra), is reproduced h ereunder:-

“7. Accordingly, th e appeal filed at the instanc e of appellants-land o wners is allowed in the afore s aid

terms and upo n calculation of 12% increase i n a compounding m anner, the market value of the land under a c quisition vide notification d a ted 09.08.1991 i s hereby enhanced f r om Rs.4,06,000/- t o Rs.6,08,744/- per acre. Needl e ss to mention that the appellants-landowners s h all also be entitl e d for all statutory benefits a nd interest provided under the Act.”

In view the aforesaid, the present appeal being devoi d of merits, it thus dismissed. 7. Pending misc. applicatio n (s), if any, shall also stand

disposed of.
