Learned counsel for the appellant submits that he is not contesting the appeal on merits but Rs.50,000/- which was deposited by him in terms of order dated 19.09.2023 passed in CWP-11742 of 2023, be refunded. Learned counsel submits that the forfeiture of the total amount should not have been done and at the most, Rs.10,000/- could have been forfeited and the remaining Rs.40,000/- should have been released back to the appellant.

Advocate, appear on behalf of the State and respondent No.6 respectively and submit that they have no objection to the said plea.

Keeping in view the totality as the appellant has not been pressed the present appeal on merits, it is directed that out of Rs.50,000/-
