Challenge is to the order dated 15.07.2024 passed by Commissioner under the Employee’s Compensation Act, 1923. Counsel has assailed quantification of the compensation.

Counsel for the appellants is not in a position to dispute that the compensation has to be computed under the 1923 Act, taking into consideration the notified minimum wages under Section 4(1)(B) and the relevant factor as provided under the schedule.

On the relevant date i.e. the date of accident i.e. 08.11.2017, wages notified by the Central Government were Rs.8,000/per month. The same has been considered by the Commissioner. Relevant factor applicable keeping in view the age of the deceased i.e. 25 years has been applied i.e. 216.91. Accordingly, the compensation has been computed and ordered to be paid apart from funeral expenses and litigation expenses.
