This is an appeal filed by the claimants seeking enhancement of compensation.

¶16

Claimants claimed that the deceased was working as Halwai and was earning Rs.15,000/- to Rs.20,000/-. In the absence of there being any cogent evidence, the Tribunal has assessed his income as per the Minimum Wages Act notified by the State Government for an unskilled labour as Rs.9,320/-. Deduction of 1/4th was applied to calculate the dependency. In view of ‘National Insurance Company Limited vs. Pranay Sethi and others’, (2017) 16 SCC 680, 40% future prospects have been granted. Loss of consortium has also been granted to all the four claimants @ 40,000/-. Rs.15,000/- has been granted under the head of loss of estate as well as the funeral expenses.
