The petitioners have approached this Court against the inaction on the part of the respondents in not releasing 2^nd time bound promotion scale to the petitioners w.e.f. the dates they became eligible and entitled as per the prevailing instructions.

Learned counsel appearing on behalf of the respondents, however, refers to the short affidavit of Er. Manish Kumar, Executive Engineer, R.M. & S.R. Division, BBMB, Nangal Township, Tehsil Nangal, District Ropar (Punjab), wherein it has been averred as under:-

“4. That after receiving the clarification that the petitioners

are entitled for the benefit of one increment on completion of 16 years service on the same pay scale. The petitioners No. 1, 3 &

4 has been granted the benefit of one increment on completion of their 16 years service. A copy Sectioned office order dated 06.11.2024,21.03.2025 and 05.02.2025 are annexed herewith as Annexure A-1 to 3.

They have also been paid benefit of pre-revised pay scale. So far as the petitioner No. 2 is concerned, it is submitted that the petitioner was transferred from the BBMB to his parent department i.e. Water Resources Department, Rajasthan, Jaipur on dated 31.05.2023 and thereafter he was expired. The service book of the petitioner No. 2 has been demanded from his parent department vide letter No.249-50/N.F dated 23.01.2025 and letter No.404-06/N.F dated 13.02.2025 As and when the service book of the petitioner No. 2 will be received by the BBMB, the legal heirs of the petitioner No. 2 will be released the benefit of one increment alongwith arrears on account of completion of 16 years service on the same pay scale. A copy of letters dated 23.01.2025 and 13.02.2025 are annexed herewith as Annexure A-4 to 5. ”

Learned counsel appearing on behalf of the respondents contends that the respondents have already taken a conscious decision to grant the benefit of one increment on completion of 16 years service on the same pay-scale and that the benefit of the same in respect of petitioner No.2 is pending receipt of information from the parent department i.e. Water Resources Department, Rajasthan, Jaipur. He contends that in principle

decision having been taken, the necessary financial benefits shall be released in a time bound manner and in any case within a period of 03 months, if not already disbursed.

In view of the above, the present writ petition is disposed as having been rendered infructuous at this stage.

Needless to mention that the respondent-BBMB shall remain bound to disburse the admissible benefits to petitioner(s) within the time frame as undertaken before this Court.
