Through the instant petition prayer is made for issuance of direction upon respondents No. 2 and 3, to remove the electric transformer from the land of the petitioner as shown in the site plan (Annexure P-3), to an appropriate place, which has been illegally shifted to the land of the petitioner bearing Khasra No. 13//22/1/2 situated in Village Bahua, Tehsil Banga, District Shaheed Bhagat Singh Nagar, Punjab.

What surfaced during the course of arguments, that the respondents No. 7 has constructed one Petrol Pump, and for the said purpose, he requires electricity, but to create pavement for better excess to

the road, respondent No.7 got the transformer shifted from his land to the land of the petitioners, whereas, the Distribution Licensee has not taken consent of the petitioners.

This matter has been heard on number of occasions, now both the parties have arrived at a consensus that the transformer may be reshifted to the original place, and the charges which has been assessed by the Distribution Licensee amounting to Rs. 1,06,938/- is also to be equally shared by the petitioners and respondent No.7. Let both the parties i.e. petitioners and respondent No.7, within fifteen days from the date of passing of this order, deposit their respective shares with respondents No. 2 & 3, and thereupon, the exercise be carried out to re-shift the transformer at its original place within one month thereafter.
