The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order of suspension dated 29.04.2021. He is further seeking direction to stay the suspension order.

From the perusal of order dated 29.04.2021, it is evident that petitioner has been dismissed from service by aforesaid order whereas petitioner in the instant petition has treated the said order as suspension order. The petitioner had remedy to file appeal against the said order. The order dated 29.04.2021 was passed after conducting departmental enquiry.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail remedies as permissible by law.
