The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to pay them salary for the higher posts which they held during their service tenure.

The petitioners are claiming that during their service tenure, they worked on the higher post under current duty charge mechanism, however, they were paid salary as payable to their substantive post. The respondent was bound to pay salary as payable to officers working on higher posts.

Learned counsel for the petitioner submits that a Coordinate Bench of this Court vide order dated 06.05.2024 passed in CWP No.10401 of 2024, Birbal Singh Kundu and others v. The State of Haryana and another has directed the respondents to consider petitioners’ legal notice and

Ms. Rajni Gupta, Additional Advocate General, Haryana, who on advance notice is present in Court on behalf of the respondents, submits that claim of petitioners is hopelessly barred by limitation, however, she expressed her inability to controvert applicability of order dated 06.05.2024 passed in aforesaid writ petition to the facts of instant case.
