Through the instant writ petition, prayer is made for setting aside the notice/order dated 09.07.2023, whereby, the respondent No.3 has directed the respondent No.4/Bank to freeze the bank account of the petitioner, in connection with FIR No.138 dated 22.06.2023, registered under Sections 406 and 420 of the IPC, at P.S. City Moga, District Moga. 2. On 21.03.2025, this Court had passed the following order upon the instant writ petition:-

“Through the instant civil writ petition (CWP-16203-2023), challenge is thrown to the notice/order dated 09.07.2023, arising of an FIR bearing No.138, dated 22.06.2023, registered under Sections 406 and 420 of the IPC (Annexure P-5), whereby respondent no.3SHO, Police Station Moga, has directed respondent no.4 to freeze the bank account of the petitioner.

On the next date of hearing, respondent no.3-SHO concerned, is directed to inform this Court by way of a specific affidavit, as to whether, the seizure memo has been prepared after making request to respondent no.4-Bank, for freezing the bank

In pursuance of the hereinabove extracted order, today the learned State counsel has, on instructions imparted to him by S.H.O./Insp. Pardeep Singh, informed this Court that, investigation in the FIR (supra) has already been completed and even the Final Report has also been presented before the Magistrate/trial Court concerned. Moreover, seizure memo is also a part of the Final Report. Therefore, in case, the petitioner has any grievance with regard to the impugned notice/order (supra) wherethrough his bank account has been directed to be freezed by the investigating officer, he can agitate his grievance before the Magistrate/trial Court concerned.

In view of the information purveyed to this Court by the learned State counsel, the petitioner is relegated to the Magistrate/trial Court for redressal of his grievance emanating from the impugned notice/order (supra).
