Pursuant to previous order passed by this Court, an affidavit of Mr. Pradeep Kumar, Executive Engineer, Public Health Engineering Division No.1, Sirsa, respondent No.5 has been filed, which is taken on record. Copy has been supplied to counsel for the petitioner. Along with an affidavit a speaking order dated 19.06.2025 has been appended, relevant extract of which is reproduced hereunder:-

“After due consideration of all available facts internal report and in strict adherence to the Hon’ble High Court order dated 19/05/2025 the legal notice dated 26.04.2025 is hereby decided with following conclusion:-

(i) The amount of Rs.23,18,759/- related to the Executive Engineer, Public Health Engineering Division No.1, Sirsa shall be processed and paid within 4 months’ time period subjected to clearance from Treasury/Finance Department and availability of LOC in maintenance in capital work Head without interest.

(ii) As intimated by Executive Engineer, Public Health Engineering Division No.2 Sirsa (respondent No.4) vide letter No. 11866 dated 19/06/2025 “an amounting to Rs.45.06 lacs on account of 139 No. bills is payable to Sh. Pawan Kumar Contractor. The physical status of all the bills have been checked and found that all bills are correct. Also, no payment of these bills has been made. It is further intimated that the payment of all the bills will be made within one year subject to availability of budget from Head Office. Demand of funds for these bills has been made from the Head Office” (Letter attached as Annexure A-4).”

Although, it is mentioned in the speaking order that the

amount of Rs.45.06 lacs would be disbursed within a period of six months, but upon instructions from Mr. Pradeep Kumar, Executive Engineer, State counsel assures that payment would be made within six months.

In view of the above, writ petition is disposed of.

In case, the amount is paid within the aforesaid period, petitioner will not be entitled to any interest. However, liberty is granted to the petitioner to claim interest if the time frame is not adhered to.
