The instant petition has been preferred by the petitioner(s) seeking issuance of an appropriate writ especially in the nature of Mandamus directing the respondents to update the HRMS data of the petitioner and to release her salary for the last 06 months.

Learned counsel appearing on behalf of the petitioner contends that the petitioner joined the respondent-Department on 01.08.1988 as a Multipurpose Health Worker (Female). He contends that vide order dated 21.10.2024, respondent No.2-Director General, Health Services Haryana promoted many employees of the department to the post of Multipurpose Health Supervisor and the name of the petitioner was duly reflected in the list of promotion at Sr. No.138. She was thereafter transferred from CHC, Jamalpur, District Jhajjar to PHC Bahu Jholri, District Jhajjar. In compliance thereto, the petitioner joined at the new place of posting on 21.10.2024. update the HRMS data of the promoted employees from HRMS Data Head 2211 to HRMS Data Head 2210, however, the same has not been undertaken as a result whereof the salary of the petitioner has not been released. The petitioner has represented the respondent(s)-authorities to update the HRMS data so that her salary may be released.

Ms. Tanisha Peshawaria, DAG Haryana accepts notice on behalf of respondent(s)-State. She submits that the matter shall be examined at an appropriate level and the necessary updation of the HRMS data would be undertaken expeditiously and the due benefits would be released accordingly.

In view of the above, the present petition is disposed of with a direction to respondent(s)-State to carry out necessary updation in the HRMS data within a period of 01 month from the date of receipt of certified copy of this order and the withheld financial benefits be released affirmatively within a further period of 02 weeks thereafter.

It is made clear that in the event of non-compliance of the above said direction(s), the petitioner shall be entitled to interest @6% per annum on the unlawful withholding of the salary of the petitioner, till its actual disbursement.
